1. Acceptance of Terms

By accessing or using the Cubos Driver mobile application or Cubos Dashboard ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.

2. Description of Service

Cubos provides fleet management software for businesses in the concrete and construction industry. Our Services include:

• Driver mobile application for order management and delivery tracking
• Web dashboard for fleet managers and administrators
• Vehicle tracking and maintenance management
• Shift scheduling and time tracking
• Reporting and analytics tools

3. User Accounts

Access to Cubos Services requires a user account created by your employer. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying your employer immediately of any unauthorized use

You may not share your account credentials or allow others to access your account.

4. Acceptable Use

You agree to use the Services only for lawful, work-related purposes. You may not:

• Use the Services for any illegal purpose
• Attempt to gain unauthorized access to any part of the Services
• Interfere with or disrupt the Services or servers
• Upload malicious code or content
• Use the Services to harass, abuse, or harm others
• Falsify data or reports
• Share confidential business information outside your organization

5. Content and Data

Your Content

You retain ownership of content you submit through the Services (photos, reports, etc.). By submitting content, you grant Cubos a license to use, store, and process that content as necessary to provide the Services.

Data Accuracy

You are responsible for ensuring the accuracy of data you enter into the Services, including odometer readings, delivery information, and maintenance reports.

6. Intellectual Property

The Cubos name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Cubos. You may not use such marks without our prior written permission.

The Services and their entire contents, features, and functionality are owned by Cubos and are protected by international copyright, trademark, and other intellectual property laws.

7. Privacy

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

8. Service Availability

We strive to maintain high availability of our Services but do not guarantee uninterrupted access. We may temporarily suspend the Services for maintenance, updates, or other reasons. We will attempt to provide notice of planned maintenance when possible.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CUBOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• Your use or inability to use the Services
• Any unauthorized access to or use of our servers
• Any interruption or cessation of transmission to or from the Services
• Any bugs, viruses, or other harmful code transmitted through the Services
• Any reliance on navigation directions, route suggestions, or estimated times of arrival provided by the Services

10. Navigation Disclaimer

The Cubos Driver app includes navigation features that provide route suggestions and turn-by-turn directions. These directions are for informational purposes only and are generated by third-party services. The driver is always responsible for safe driving and compliance with all traffic laws, road signs, and local regulations. Cubos does not guarantee the accuracy, completeness, or suitability of any navigation directions. Cubos shall not be liable for any accidents, damages, traffic violations, vehicle damage, or any other losses arising from the use of or reliance on navigation features provided by the Services.

11. Indemnification

You agree to defend, indemnify, and hold harmless Cubos and its officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Services or violation of these Terms.

12. Termination

Your access to the Services may be terminated by your employer at any time. We may also terminate or suspend your access immediately, without prior notice, if you breach these Terms.

Upon termination, your right to use the Services will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes through the Services or by other means. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
